Sphero, Inc. (“Sphero”, "we" or “us”) is committed to protecting your privacy. This privacy policy (“Policy”) describes how your information is collected, used, and disclosed by Sphero from users of our mobile application known as the Ultimate Lightning McQueen™ by Sphero® App (the “Application”), the Ultimate Lightning McQueen app-enabled car (the “Car”), and the services we offer through our Application (together with the Application, the “Services”). This Policy does not apply to websites, applications, or services that display or link to different privacy statements.

Types of Data We Collect. We collect information from users as described below.

Information You Provide to Us

If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply.

Information Collected via Technology Automatically

The Car. When you choose to associate your Car with the Application, the Car will transmit certain device information to the Application and to Sphero automatically, including information about turns, crashes, donuts, acceleration data, and the like.

Mobile Services. We may also collect other information from your mobile device if you have downloaded our Application. Examples of information that may be collected and used include country and region of use, type of mobile device, mobile device software version, device carrier, Car and mobile device identifiers, date/time stamps, and diagnostic data regarding how you use the Application and your Car.

Service Companies. We use third-party service providers to help provide and host the Application and the Service: for example, Flurry Analytics (collectively the “Service Companies”). These Service Companies automatically collect information such as how often users use the Service, device type, and what features they use. We use the information we get from these Service Companies to improve our Application and Services.


Use of Your Information

General Use. In general, information you submit to us is used as described in this Policy and as disclosed to you in our Services or in connection with our Services. For example, we use your information in the following ways:

to operate and improve our Application and Services, internal operations, and systems;

to provide the Services you request and Services that are relevant to you;

to improve the quality of experience when you interact with our Application and Services;

to understand you and your preferences to enhance your experience and enjoyment using our Services;

to respond to your comments and questions and to provide customer service; and

to protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.

Creation of Anonymous or Aggregate Data. We may create anonymous or aggregate data records from your information by excluding information that makes the data personally identifiable to you. We use this data for a variety of purposes, such as to analyze request and usage patterns so that we may enhance the content of our Services and improve Application navigation.

Disclosure of Your Personal Information. We do not share your information other than as described below and as described elsewhere in this Policy.

With Your Consent. We may share information with your consent.

Third-party Service Providers. We may share your information with third-party service providers who need access to your information to do work for us, such as to host our Applications and Services on third-party servers; to conduct quality assurance testing; and to provide technical support and crash analytics.

Corporate Restructuring. We may share your information in connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction, or proceeding involving the sale, transfer, divestiture, or disclosure of all or a portion of our assets or business to another company.

Other Disclosures. We may disclose information (i) in connection with any legal investigation; (ii) to comply with relevant laws or to respond to legal process served on Sphero; (iii) to protect or defend the rights or property of Sphero, our agents, or users of the Application or Services; (iv) in an emergency to protect the personal safety of any person; and/or (iv) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Use. We may share anonymized information with third parties for their own use. We may also share aggregated information with third parties for their own use.

Your Choices Regarding Your Information. You have several choices regarding use of information on our Services:

Data Collection. You can stop future collection of information by the Application by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace where you obtained the Application.

Except as allowed by law, we do not collect personally identifiable information about your online activities over time and across third-party Web sites or online services. Where we do collect such information, we may not respond to Web browser "do not track" signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personally identifiable information about an individual consumer's online activities over time and across third-party Web sites or online services. Where allowed by law, other parties may collect personally identifiable information about your online activities over time and across different Web sites when you use our Applications and Services.

Security of Your Personal information. Sphero is committed to taking reasonable steps to protect your information in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration, and destruction.

Changes to This Privacy Policy. This Privacy Policy is subject to occasional revision. If we make any changes to this Policy, we will change the "Last Updated" date above.
